THIS AGREEMENT IS MADE BETWEEN USA CREDIT RECOVERY, INC., HEREIN REFERRED TO AS USA Credit Recovery AND ______________________________________________ HEREIN REFERRED TO AS CLIENT.

USA Credit Recovery GRANTS YOU THE RIGHT TO ESTABLISH AN ACCOUNT WITH THIS SITE ONLY UPON THE CONDITION THAT YOU ACCEPT ALL OF THE TERMS CONTAINED IN THIS AGREEMENT CALLED NO RECOVERY NO FEE TERMS OF SERVICE

PLEASE READ THE TERMS OF SERVICE CAREFULLY. 

BY CLICKING ON “YES", YOU ARE INDICATING THAT YOU ACCEPT THE TERMS OF SERVICE. IF YOU DO NOT AGREE WITH THESE TERMS, THEN USA Credit Recovery IS UNWILLING TO GRANT YOU RIGHTS TO ESTABLISH AN ACCOUNT.

1. Upon placement of a claim(s), where a Debtor owes funds to CLIENT, USA Credit Recovery will use its best efforts to expeditiously collect the claim on behalf of CLIENT. USA Credit Recovery agrees to charge a commission only on funds actually paid by Debtor to USA Credit Recovery or Client and not the actual amount owed, subject to the provisions of paragraphs 4, 5 and 7 below. 

2. CLIENT warrants the validity, amount and authenticity of all claims and accounts placed with USA Credit Recovery for collection. Upon request by USA Credit Recovery, CLIENT agrees to forward documentation to USA Credit Recovery to prove the amount, and authenticity of the claim when requested. 

3. USA Credit Recovery shall notify CLIENT of any settlement offers received by USA Credit Recovery and no settlement offer shall be accepted by USA Credit Recovery without CLIENT\'S express consent. 

4. CLIENT may withdraw a claim placed with USA Credit Recovery only where a) there has been no activity on the account in the preceding sixty (60) days and b) the claim is not in litigation or involved in an insolvency proceeding. All withdrawals must be done in via e-mail to corporate@usacreditrecovery.com by CLIENT and any commission then due and payable to USA Credit Recovery must be paid before the claim is deemed withdrawn. Any claim canceled by CLIENT while payments are being made by debtor will be billed by USA Credit Recovery for the full anticipated commission due USA Credit Recovery on the entire amount of the original claim assigned to USA Credit Recovery . There is a fee of 10% of the principal balance of the account for administrative, initiation and clerical expense on all accounts withdrawn by CLIENT not in accordance with the provisions of paragraph 4a and 4b. 

5. CLIENT shall report all direct payments made by Debtor to CLIENT to USA Credit Recovery within three (3) business days of receipt of payment by CLIENT via e-mail to corporate@usacreditrecovery.com, and the commission due USA Credit Recovery on the direct payment shall be remitted to USA Credit Recovery within (21) days.

6.  All claims placed with USA Credit Recovery by CLIENT, that are under one (1) year in age shall be billed by USA Credit Recovery to CLIENT at a rate of 30% of any and all funds collected by USA Credit Recovery on behalf of CLIENT. All claims placed with USA Credit Recovery by CLIENT that are over one (1) year in age shall be billed by USA Credit Recovery to CLIENT at a rate of 40% of any and all funds collected by USA Credit Recovery on behalf of CLIENT. Any claim, regardless of age, that is less than $500 shall be collected at a rate of 50%. Any claim, regardless of age, that requires litigation shall be collected at a rate of 50%. 

7.Any merchandise returned to CLIENT by Debtor after initial contact by USA Credit Recovery shall entitle USA Credit Recovery to a commission equal to 10% of the actual invoiced amount where CLIENT invoiced Debtor for the equipment returned. 

8. Any claim placed with USA Credit Recovery by CLIENT that is discovered to have been previously paid by Debtor or placed by CLIENT error will be billed by USA Credit Recovery to Client at a rate of 10% of the claim as an administrative, clerical and initiation fee. 

9. USA Credit Recovery shall account to CLIENT on a monthly basis all funds collected by USA Credit Recovery for CLIENT\'S behalf and all remittances and/or invoices will be sent at this time.

10. CLIENT grants to USA Credit Recovery and any attorney or collection firm that USA Credit Recovery may forward clients case to express authority to endorse and negotiate any check, draft or other negotiable instrument made payable to CLIENT for deposit in trust for distribution to CLIENT after deducting the commission and fees due USA Credit Recovery under this agreement. 

11. CLIENT understands that USA Credit Recovery may at their discretion forward a case or a claim to an outside law firm or collection network to assist in the recovery of said account and hereby grants USA Credit Recovery permission to do so. It is further understood that CLIENT must give USA Credit Recovery approval in the event that such a transfer will result in additional charges. 

12. In no event shall USA Credit Recovery be liable in any respect for the inability to collect any account placed with USA Credit Recovery by CLIENT for collection. It is understood and agreed that USA Credit Recovery is not a guarantor of any specific result on accounts placed by CLIENT. 

13. USA Credit Recovery agrees and shall hold harmless CLIENT from any claim, demand, action, cost or judgment, including a reasonable attorney\'s fee arising out of any action done or failing to be done by USA Credit Recovery in connection with the collection of any claim(s) place with USA Credit Recovery by CLIENT for collection. 

14. This agreement shall be construed in accordance with the laws of the State of Florida. In the event that any provision hereof is found to be invalid or unenforceable, then that provision shall deemed to be severed and removed and the remaining provisions shall remain valid and in full effect.

A collection agency is a business that pursues payments on debts owed by individuals or businesses. Most collection agencies operate as agents of creditors and collect debts for a fee or percentage of the total amount owed.

Some agencies, sometimes referred to as "debt buyers", also purchase debts from creditors for a fraction of the value of the debt and pursue the debtor for the full balance.
Creditors typically send debts to a collection agency in order to remove them from their accounts receivable records; the difference between the amount collected and the full value of the debt is then written off as a loss.

First Party Agencies

Some agencies are departments or subsidiaries of the company that owns the original debt. First party agencies typically get involved earlier in the debt collection process and have a greater incentive to try to maintain a constructive customer relationship.
Because they are a part of the original creditor, first party agencies are not subject to some of the laws which govern collection agencies.

These agencies are called "first party" because they are part of the first party to the contract (i.e. the creditor). The second party is the consumer (or debtor).

Third Party Agencies

The term collection agency is usually applied to third party agencies, called such because they were not a party to the original contract.

The creditor assigns accounts directly to such an agency on a contingency fee basis, which initially costs nothing to the creditor or merchant except for the cost of communications.

The collection agency makes money only if money is collected from the debtor (often known as a "No Collection - No Fee" basis). The agency will take a percentage of the amount collected as its fee, which can range from 30% to 50% depending on the type of debt (though more typically the fee is 30% to 40%).

Another option for creditors is to sell their debts to the fast growing debt buying industry. This allows the creditor to generate immediate revenue from their accounts receivables, save infrastructure costs associated with managing collection agencies, and avoid the possible legal liability and public relations risks associated with debt collection.

Collection account

Collection account is the term used to describe a person's loan or debt which has been submitted to a collection agency through a creditor.
The term is not used on debts with only original creditors.

The collection account normally appears on the credit report of a person (debtor) who has had one or more accounts referred to collection agencies, within the last seven years.

The name of the collection agency, and the amount of money a person owe, will be listed in the report. Also, in some cases, the agency's contact information is listed.
If a debtor pays off a collection account, the item will not be removed from the credit reports - it will simply be marked "Paid."
